Terms & Conditions

By using Cigar AI, you agree to the following Terms & Conditions.

1. Eligibility

You must be of legal smoking age in your jurisdiction, including 21+ in the United States, to use this App. You are responsible for following all tobacco-related laws that apply to you. Cigar AI does not sell tobacco products.

2. Use of the App

Cigar AI provides:

• AI-based cigar identification
• Personal journaling, humidor inventory, and analytics
• AI chat, import, recommendations, and taste-profile tools
• Optional Flavors/community sharing features
• Educational and informational content for adults of legal smoking age

3. Account Responsibility

You are responsible for your account, login credentials, and activity under your account. You agree to provide accurate account information and to notify us if you believe your account has been accessed without permission.

4. License and Intellectual Property

All App content, branding, and software are the property of Cigar AI unless otherwise stated. We grant you a limited, personal, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, reverse engineer, or attempt to bypass any part of the App without our permission, except where applicable law allows it.

5. No Medical or Professional Advice

All information provided by the app is for informational purposes only and should not be considered medical, health, or professional advice.

6. User Content

• You retain ownership of content you upload.
• By using the App, you grant us a limited license to store, process, display, analyze, and transmit your content as needed to operate, secure, support, and improve the App.
• If you choose to share content through Flavors/community features, you grant us permission to display that content and related public profile information to other users.
• You are responsible for content you upload, export, share, or publish, including making sure you have the rights and permissions needed to use it.

7. Community Rules

If you use Flavors/community features, you agree not to post content that is unlawful, harassing, hateful, misleading, infringing, malicious, private, or otherwise harmful. Do not upload other people's private information or images without permission. We may moderate, hide, remove, or restrict content or accounts that violate these Terms or create risk for the App or other users.

8. AI Features

AI identification, Havana chat, recommendations, import enrichment, flavor profiles, and generated text are provided for convenience and may be wrong or incomplete. You are responsible for checking important information before relying on it.

9. Subscriptions & Purchases

• Some features require a paid subscription.
• Payments and entitlement management may be handled by RevenueCat, Apple App Store, Google Play, or web checkout providers.
• Subscriptions may renew automatically unless canceled through the applicable billing provider before renewal.
• Trials, renewals, cancellations, lifetime purchases, and refunds follow the policies of the applicable billing provider.
• Deleting the App or deleting your Cigar AI account does not automatically cancel a subscription.

10. Acceptable Use

You agree not to:

• Use the app for illegal purposes
• Abuse, reverse engineer, or attempt to bypass usage limits
• Upload harmful or malicious content
• Scrape, overload, disrupt, or interfere with the App or its infrastructure
• Misrepresent yourself, violate another person's rights, or use the App where it is unlawful for you to do so

11. Third-Party Services

The App uses third-party services, including Firebase/Google, Google Gemini, PostHog, RevenueCat, Apple App Store, Google Play, reverse-geocoding providers, and external share/export destinations. Those services may have their own terms, privacy policies, billing rules, and data practices.

12. Exporting and Sharing

You may export or share some App content through operating system or browser sharing tools. Once you share or export content outside Cigar AI, you are responsible for how that content is used by the destination service or recipient.

13. Availability & Changes

We may:

• Modify or discontinue features
• Update the app or these Terms at any time

14. Limitation of Liability

Cigar AI is provided "as is" without warranties of any kind. We are not liable for damages arising from use or inability to use the app.

15. Termination and Account Deletion

We reserve the right to suspend or terminate access if these Terms are violated. You may delete your account from within the App when signed in, or submit a deletion request if you cannot access your account. Account deletion removes app-owned account data but does not automatically cancel subscriptions, and does not guarantee deletion of records retained by third-party providers or required for legal, security, billing, or fraud-prevention reasons. Termination does not automatically entitle users to refunds, subject to the applicable billing provider policies.

16. Governing Law

These Terms are governed by the laws of the United States and the State of New York.
